These general terms and conditions apply when you as a consumer place an order via our website Webshop.cykelfabriken and related pages. An agreement is entered into between you and Cykelfabriken AB, organization number SE559403161901, when you as a consumer place an order through our website Webshop.cykelfabriken and its associated pages. Detailed contact information and other information about Cykelfabriken AB can be found under “Contact us”. These terms and conditions apply only to you as a consumer placing orders through the website. Cykelfabriken AB is the company that owns Webshop.cykelfabriken.

We follow the General Complaints Board (ARN).

To be able to place an order via the website, you must have reached the age of 18. According to Swedish law, we do not accept credit purchases for individuals under the age of 18. We reserve the right to refuse or change your order in individual cases (for example, if you have provided incorrect personal information and/or have payment defaults).

To make a purchase, you must accept our terms and conditions. By accepting our terms, you commit to following the terms in their entirety and agree that you have read and accepted the information about personal data and consented to the use of personal data and cookies.

An agreement to purchase is only formed when we have confirmed your order and you have received an order confirmation from us via email. We encourage you to save this order confirmation for any future contact with our customer service.

When ordering on any of our websites, the prices displayed on the website apply. Prices are stated in Swedish kronor and include VAT. The prices do not include payment and shipping fees, which are stated separately.

We have the right to charge you at the time of ordering, unless invoice payment or other similar payment method has been chosen by you and approved by us. In case of invoice payment or installment payment, our partner may perform a credit check. We reserve the right to not always offer all payment methods, or alternatively change the payment method if the one you have chosen for some reason does not work at the time of purchase. Please note that any limitations on payment options are specified on the website.

We may from time to time offer promotions on the website that may have more favorable conditions than those stated in these Terms, for example: Regarding payment or extended right of withdrawal.   1. Right of withdrawal and open purchase

When purchasing goods on any of our websites, a 14-day right of withdrawal/open purchase applies in accordance with applicable consumer protection legislation. This means that you have the right to withdraw your purchase by notifying us within 14 days from the day you or your representative received the ordered item (the withdrawal period).

The right of withdrawal does not apply to the following types of goods:

(a) goods with broken seals. If a product has been sealed, you cannot break the seal if you want to exercise your right of withdrawal. The right to withdraw ceases when you break the seal.

(b) if the product has been used.

Right of withdrawal – in distance selling

When purchasing through our online store or telephone, the “distance selling law” applies. This means that you as a customer have the right to cancel your purchase within 14 days of receiving the item. The product must be in as good condition as when you received it, ie unused and undamaged. Original packaging must be in use. you as the customer have to pay for the return freight with a trackable shipping. When purchasing a product that is custom-made or otherwise clearly personalized for you, the right of withdrawal does not apply.” The right of withdrawal dose not apply .

If you want to withdraw your purchase, you must, before the withdrawal period has expired, send a clear message to us in the manner specified here. You should provide your personal identification number, name, address, and other relevant information, such as: order number, invoice number, and name of the item in the message. If you do not want to use the above options for your message, you can use the standard form for exercising the right of withdrawal that the Swedish Consumer Agency has developed (see www.konsumentverket.se)

7.5
When exercising the right of withdrawal, you are responsible for paying the return shipping cost and for the condition of the product after you have received it, as well as during the return shipping. The product must be returned within 30 days from the date on which the notice of withdrawal was given to us The product must be returned well-packaged, in good condition, and in its original box. Returns must be made to us according to the methods and instructions specified on the website, which can be found here.

Price examples for return shipping: Small package: 100 SEK Pallet shipping (e.g. bicycles): 700 SEK When exchanging accessories such as gloves, helmet, or shoes for a different size, we cover the shipping costs as part of our exchange policy. However, this only applies if the returned item is in its original packaging. For helmets any stickers or tags must be intact and undamaged in order to be eligible for exchange or return. Save the original packaging in which your item was delivered. If the return shipping cost is affected due to inadequate packaging, you as a customer are responsible for these costs. during delivery to you, we are responsible for the transport risk, i.e. the risk of the product being damaged or lost during transportation. When delivering to you, we are responsible for the transport risk, meaning that if the product is damaged on the way from our warehouse to you, it is under our responsibility. If you return a product, you are responsible for the transport risk. Make sure to provide sufficient information when returning or exchanging a product to facilitate handling at our end. Provide your name, social security number, phone number, and the order number related to the return.

7.6
When you exercise your right of withdrawal, we will refund the amount you paid for the product, including any delivery costs. If you cancel your purchase, we will refund the amount you paid for the product, including delivery costs. However, we reserve the right to deduct an amount equal to the depreciation of the product compared to its original value, to the extent that such depreciation is due to your handling of the product to a greater extent than is necessary to determine its properties or function.

Warranty for products only covers original manufacturing defects, and thus does not cover any defects that arise during or after a modification of the product’s function and appearance, such as rebuilding, upgrading, or any other configuration of the product. The right to make a complaint covers goods that are faulty according to applicable consumer protection laws. The customer who wishes to make a claim for a defect in the ordered item should contact us as soon as possible after the defect has been discovered, using the contact information provided on the website. Complaints made within two months from the date when you discovered the defect will always be considered to have been made in due time. You have a 3-year right to complain about products purchased on the website. Always make a complaint as soon as possible to ensure that you do not lose your rights.

We always cover the return shipping costs for approved claims.

Once the claimed product has been returned and the complaint has been approved, we will compensate you in accordance with applicable consumer protection legislation. Cykelfabriken do not take the responsibility from damages and other penalties if the fulfillment of the agreement is hindered or hampered by any circumstance – for example, war, government intervention, disturbances, restrictions on energy supply, labor market disruptions, prohibitions, restrictions, absent licenses, non- accidental deliveries from subcontractors, as well as non-contractual deliveries..

  1. Terms and conditions for in-store purchases.
    When purchasing in a physical store, it is the respective store that sets the terms and conditions for the sale. Some stores may not offer a “right of withdrawal” (open purchase) policy. Be sure to always ask about the terms and conditions when purchasing in any of our or our retailers’ stores.
